I just got an email from my fiance in Russia that she was told by her girlfriend (who is a Russian citizen, but lives in Virgina because of her Russian husban's work) that once here in the US, she would not be able to leave for three years.

I told her this was not true, but then I started thinking......very little thinking, because I realy don't know what travel restrictions would be placed on her.

With all the sh** happening in the world, I don't know how the Homeland Security is viewing free-flowing travel of non-citizens, married or not. Especially now with what is going on in Russia.

The good news is that she can leave at anytime. There are no restrictions by nationality for persons wishing to leave the U.S.

The bad news is that it may be difficult for her to re-enter the U.S. for some time. The K-1 visa is good for only one entry into the U.S. Once you marry, you will need to file an AOS (Adjustment of Status), which is her application for her (Conditional) Resident Alien Card (aka Green Card). Once she receives this, she may enter the U.S. as many times as she wishes. Time to process these applications have run from 6 months to over 2 years.

In the interim, she may file for advance parole, allowing her to travel and return to the U.S. Depending on your field office, this can be relatively painless to downright frustrating to get. Here in VT, we are hoping to get my wife's in the promised 30-60 day processing time.
