need some advise

Hello Rmp. I was hoping someone could help me or possibly post a link for me. Now that I am married, what is the next step. I was under the assumption that after all the marriage information was filed at the courthouse, I would receive a government package and forms to fill out to establish my wife's citizenship. Is this something that must be done by a lawyer, or is there downloadable forms we can fill out. Any help would be greatly apreciated.

Thanks easytarget. One more question. I could not find the answer on the site. How long do you have to do all these requirements. We did the K-1 visa, now we are married. There is only one month left on her visa. Does she need to have aproval/permanent residency status by the time the visa expires? Do the forms just have to be filled out by this time? I read on the site that you gave me that aproval can take months..Does this mean she has to go back before her visa expires? I have been working alot of hours the past few months, and now know that there is alot of research that I did not do. Starting to get a little scared now. O K, I guess that was more than just one question.

No, she does NOT go back to her home country. This the whole point of the K1, you get married and live happily ever after.

HOWEVER, you do need to file for the AOS BEFORE her visa expires; otherwise she could be considered out of status.

By the way, have you gotten her SSN card yet? You do need to do this quickly.

She does not need to go back. You can file papers at any point, even after her visa expires, but don't wait for more than 6 months or you will have to pay the fine due to her being out of status for more than 180 days.
Once you file the papers, she is granted AOS (Adjustment of Status) status. If you file forms for Empoyment Authorisation (they are separate from AOS), she will be able to get a SSN and start working before the decision on her status is made.

Don't get scared. It is a pretty straight forward procedure. AOS takes up to several months (sometimes more than an year) to get approved.

O.K. , need some help again. If someone could PM me, I would greatly apreciate it. 1st, do I just go to the courthouse to apply for a social security number for my wife? 2nd, I am having some problems with filling out the adjustment of status forms. Do I leave the ssn box blank, or obtain one before filling out this form? Not sure what A#(if applicable) is. Current USCIS Status? and expiration? Last Entry, would I put New York where we 1st entered, or San Francisco-our final destination? On the nonimmigrant visa number, do I use the control number, or the visa number? Consulate where visa was Issued, would this be Kiev? And what forms do I need to send off with this package? I'm not sure of one of the forms they ask for, and think we gave it to customs upon entry into the U.S. Also, on the G-325-A it asks for a File number and there is a capital A in the box, which confuses me. Our file number started with KIEV2006.

Sorry for all the questions, but I'm getting worried, and not sure what to do. I have been working 60 hour weeks since we have been back to the U.S. and all offices are closed when I'm off. My lawyer took a leave of absense untill the end of August as well.

Once again, any help would be greatly apreciated!

Ok, Jason, here is how it goes.
If she does not have ss#, don't put anything into the form. A# is the number that USCIS assigns to aliens that are going through the AOS process. If your wife has arrived here on K3 (wife) visa, she might have one in her passport. Look carefully there, they usually write A# by hand.
If she arrived on k1 visa, she des not have any number, so leave the line blank.
Current USCIS status is her status in the country. What kind of visa she has, when does it expire. Port of entry is where she has entered the US and was inspected by customs. In your case, it is going to be NYC.
For non-immigrant visa number it is the visa number. Your wife should know where she got her visa. If it was in Kiev consulate, than put Kiev consulate down.
About the forms that you have to send with the package, you better consult USCIS directly, or at least visit their website, and see what is needed for AOS. Some people choose not to file for work authorization or advance parole. It is really up to you and your wife.

The form that they are asking about is I-94 that should have been stapled into your wife's passport upon the customs inspection.
Read carefully all the forms. You are not supposed to enter any file numbers, it is generally the job of a USCIS clerk. Anyway, any number that starts with capital A is an Alien number that I've mentioned above. Your wife, probably, does not have it yet.

If you are confused about the forms and the whole process, the best thing is to consult an immigration lawyer. It might be a bit expensive, but they definitely know how to file everything and will help you to navigate the process. Plus, whatever we can advise you on this site might not apply to your situation, while a lawyer will look at everything carefully and suggest what is best for you.
